Terms of Service

1. About Us

MK PhotoFactory is a professional photography and videography studio based in Hyderabad, Telangana, India. We provide event photography, wedding photography, videography, and related creative services.

2. Bookings & Confirmation

• All bookings are subject to availability and confirmed only upon receipt of an advance payment (booking deposit).
• A booking is considered confirmed only after you receive a written confirmation from MK PhotoFactory.
• We reserve the right to decline any booking at our discretion.
• Submitting an enquiry form does not guarantee availability or constitute a confirmed booking.

3. Payments

• A non-refundable advance deposit (typically 30–50% of the total package price) is required to secure your booking date.
• The remaining balance is due on or before the date of the event or shoot, unless otherwise agreed in writing.
• All prices are quoted in Indian Rupees (₹) and include applicable taxes unless stated otherwise.
• Packages and pricing are subject to change. Prices confirmed at the time of booking will be honoured.

4. Cancellations & Rescheduling

• Cancellation by client: The advance deposit is non-refundable under all circumstances. If cancellation is made less than 30 days before the event, the full package amount may be charged.
• Rescheduling: Date changes are subject to availability and must be requested at least 30 days in advance. One rescheduling is allowed at no additional charge. Subsequent changes may incur a fee.
• Cancellation by MK PhotoFactory: In the unlikely event that we must cancel due to unforeseen circumstances, we will provide a full refund of all amounts paid, or offer an alternative date. Our liability is limited to the refund of payments made.

5. Delivery of Photographs & Videos

• Edited photographs are typically delivered within 3–4 weeks after the event. Timelines for video production vary by package.
• All deliverables will be provided via an online gallery or digital download link unless a physical product (album, USB) is included in your package.
• We retain the right to select which photographs are included in the final delivery. Not all images captured will be delivered.
• RAW/unedited files are not provided unless specifically agreed in writing.

6. Copyright & Usage Rights

• MK PhotoFactory retains full copyright ownership of all photographs and videos created.
• Clients are granted a personal, non-commercial licence to use the delivered images for personal use (printing, sharing on personal social media, etc.).
• Commercial use of images (advertising, editorial, commercial campaigns) requires a separate written agreement and additional licensing fee.
• Clients may not sell, transfer, or sublicense the images to any third party without prior written consent.
• MK PhotoFactory reserves the right to use all images for portfolio, marketing, and promotional purposes unless a written opt-out is received before the shoot date.

7. Client Responsibilities

• Clients are responsible for informing us of any specific requirements, restrictions, or sensitivities related to the event before the booking date.
• Clients must ensure reasonable access to the venue and cooperation from guests where necessary.
• We are not responsible for missed moments due to restrictions imposed by venue management, religious leaders, or other third parties.
• Any special requests (e.g. specific shots, group photos) must be communicated in advance. We cannot guarantee all requests will be fulfilled.

8. Force Majeure

MK PhotoFactory shall not be held liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, government restrictions, power outages, illness, or other unforeseen emergencies. In such cases, we will make every effort to reschedule or find a suitable replacement photographer.

9. Equipment & Backup

We use professional-grade equipment and take reasonable precautions, including backup cameras and storage media. However, in the extremely rare event of equipment failure or file corruption, our liability is limited to a refund of amounts paid. We are not liable for any consequential losses.

10. Online Gallery & File Storage

• Online galleries are hosted for a limited period as specified in your package (typically 6–12 months).
• Clients are strongly advised to download and backup all delivered files promptly.
• MK PhotoFactory is not responsible for loss of files after the gallery expiry period.

11. Conduct & Safety

We reserve the right to withdraw our services at any event where our staff experience threatening, abusive, or unsafe behaviour. In such cases, no refund will be provided for work already performed.

12. Limitation of Liability

To the maximum extent permitted by law, MK PhotoFactory's total liability to the client for any claim arising from our services shall not exceed the total amount paid by the client for the specific service in question. We are not liable for any indirect, incidental, or consequential damages.

13. Governing Law

These Terms of Service are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

14. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with a revised date. Continued use of our services after any changes constitutes acceptance of the updated terms.
